The U.S. employer must first obtain a labor certification from the Department of Labor (DOL), proving there are no qualified U.S. workers for the position. This step ensures the foreign worker won’t displace local talent.
After the labor certification is approved, the employer files an immigrant petition (Form I-140) on behalf of the foreign worker. This petition establishes that the worker meets the necessary qualifications for the job.
Once the I-140 petition is approved, the applicant can apply for a Green Card. If the worker is already in the U.S., they can apply for an Adjustment of Status (Form I-485). If they are outside the U.S., they go through Consular Processing at a U.S. embassy or consulate.
